Terms of Service
Acceptible Use Policy
This document outlines the terms of service and acceptable use policy
for Pacific Blue Web Solutions' services. Upon registration for a new account,
the customer agrees to comply with the procedures and restrictions of their
account with Pacific Blue Web Solutions.
Failure to comply with these regulations and requirements will result
in suspension of account, which will disrupt service. Continued abuse and
refusal to comply with these specific regulations will result in account
termination without refund. Warnings will be issued prior to suspension
or termination, unless the staff determines the activity is an immediate
threat, or after repeated failures of the account owner to comply with
these guidelines. Pacific Blue Web Solutions reserves the right to enforce
these regulations to the extent permissable by law in the United States.
1. Jurisdiction
Pacific Blue Web Solutions operates under the laws of the United States
of America. Users of other countries are completely welcome, this is
only to state that legal protection that may be provided from other countries
does not apply, as our services are based in the US.
2. Restricted Website Content
In order to keep our services free of content that would pose a potential
threat to the services provided to all our users, and also to abide by
the laws of the land, the following content is restricted.
* Adult Content - Will result in account termination.
* Copyrighted material of any kind.
* Intellectual property violations, and the using or selling of illegally acquired
content.
* Unlawful data or services of any kind - including but not limited to pirated
software, pirated media files(audio or video), websites that promote or encourage
breaking laws.
3. No Unlawful Material or Activities
Pacific Blue Web Solutions does not tolerate unlawful use of it's servers
and resources. Abuse will result in suspension and ultimately termination
of account. The following content and/or activities are prohibited on
Pacific Blue Web Solutions' servers.
* Pirated software - Any files or activities that relate to or support
the distribution of illegally obtained software.
* Any content that threatens, harrases, victimizes or discriminates.
* Any service that is a nuisance, is offensive, or seeks to damage individuals,
organizations or computer networks.
* Viruses - Any programs, scripts, or files of any kind that seek to impair
or disable computer systems, or comprimise their security.
* Hacking or Cracking - Any attempt to gain unauthorized access to electronic
resources, or any activity aimed at this purpose , or the use of any tools
that may compromise the security of computer resources, or exploit security
issues.
* Modifying network information to deceive or mislead - Attempting to masquerade
as another user or computer
* Any terrorist supporting content or activities
4. System and Network Security
Pacific Blue Web Solutions seeks to maintain a high-performance computing
environment. The following programs and activities are prohibited, and
if found participating, the account involved will be subject to suspension
and/or termination.
* Malicious programs of any kind
* Circumventing user authentication
* Attempting to gain unauthorized user access - either to outside web servers
or other Pacific Blue Web accounts
* Interference to Pacific Blue Web Solutions' services, or the services of
the servers it operates. Interference includes any resource or activity that
compromises the performance of a server, or excessively uses the server's resources,
and disrupts the service, or quality of service of other accounts.
5. SPAM Restricted - Unsolicited Commercial E-mail (UCE)
SPAM as defined here is any communication(especially e-mail) that is delivered
without a request for the content described. It is most commonly known
through mass e-mails to individuals whom the sender does not have a working
relationship with. Our servers are not to be used for this purpose for
a couple of reasons. It is unlawful in many cases, and it significantly
hogs server resources, and is a nuisance to the internet community at
large.
This restriction does not include opt-in mailing lists and other services
that have been requested, yet a way for subscribers to remove themselves
from the list must be included.
6. Billing and Service
Pacific Blue Web Solutions agrees to provide web hosting and other services
to end users so long as the Terms of Service are met and payment has
been received. Web hosting services will be granted to customers upon
successful payment receipt. All services must be paid in advance before
access privileges are granted.
Invoices will be sent out when payment is due, and all billing activities
will be coordinated through the billing panel. If payment is 5 days overdue,
the account will be suspended, and after 10 days the account will be subject
to termination, unless arrangements have been made with Pacific Blue Web
Solutions Staff.
7. Account Suspention, Termination and Cancellation
Accounts with Pacific Blue Web Solutions are subject to suspension or termination
if the account violates these terms and guidelines as determined solely
by the staff of Pacific Blue Web Solutions. Account termination due to
abuse will forfeit any refund for services that may have been purchased,
no exceptions.
If you wish to cancel your account with Pacific Blue Web Solutions, submit
a help desk ticket stating that you would like your account cancelled,
and the reason why. You will be contacted by e-mail to confirm the request.
Accounts that are volutarily closed within the 15-day Satisfaction Guarantee
period will be refunded the initial payment minus the domain name fee.
We will not hold on to your domain names, and thus your refund will not
include the domain registration fee.
We appreciate your compliance with these guidelines to assure the best
possible service for all of our users, and to protect the rights of our
users, as well as others around the world. We seek to give our customers
the best service, and ask for your help to keep our service performing
at it's best!
